OF THE KITCHENSHOP LOYALTY PROGRAMME
(the "Official Rules")

ARTICLE 1. ORGANISER AND PUBLIC INFORMATION

This loyalty programme is organised and carried out by KITCHENSHOP SRL, with registered office in Romania, Bucharest, Burdujeni Street no.3, block A13, staircase 3, ground floor, ap.26, Sector 3, registered with the Trade Register under no. J40/7883/2001, unique registration code RO14180084, account RO63BACX0000004516781000, opened with Unicredit Țiriac Bank, hereinafter referred to as the "Organiser".

Participants in this programme are obliged to comply with the terms and conditions of the Official Regulation, as set out below (hereinafter referred to as "Official Rules"). The Official Rules are available to any participant in the programme for online consultation on the website www.kitchenshop.eu. The Organiser reserves the right to amend these Official Rules at any time, and such amendments shall enter into force only after prior public notice of such amendments has been given through the same channels of communication specified above.

ARTICLE 2. PROGRAMME AREA

The Loyalty Programme is organised and carried out in KitchenShop online. The Loyalty Programme may also be organised and carried out at KitchenShop partners when appropriate.

ARTICLE 3. DURATION OF THE PROGRAMME

The Loyalty Programme was launched on 01 November 2015 and has an indefinite duration. The organiser has the right to decide at any time to terminate or modify the programme. Notice of the termination of the programme will be posted by KitchenShop at least 15 calendar days prior to the date of termination or modification of the programme on the website www.kitchenshop.eu. The programme will be conducted in accordance with the provisions of these Official Rules.

ARTICLE 4. CONDITIONS FOR PARTICIPATION

Any natural person who has reached the age of 18 (hereinafter referred to as the "Participant") may be a member of the KitchenShop Loyalty Program. Persons under the age of 18 may participate only with the written consent of a family member. The natural person presenting the loyalty card ("Member") when purchasing products has the right to choose to issue invoices to a legal entity, authorised natural person, foundation, association or other form of collective organisation, and the accumulated points will be transferred to the account of the natural person presenting the card.

ARTICLE 5. CONDITIONS FOR OBTAINING A LOYALTY CARD

The KitchenShop (Member) Loyalty Card is issued electronically, free of charge, to any natural person who is registered in the Kitchen Shop database or who purchases products or services from KitchenShop, on www.kitchenshop.eu, under the conditions that they accept and comply with the terms of these Rules. The card is assigned to a single customer in the database and is non-transferable, the organiser's representatives having the right to check its authenticity and validity.

The Loyalty (Membership) Card can only be obtained by completing the registration form. The registration form is available online at www.kitchenshop.eu when placing an order.

The participant is obliged to provide true and complete information for all fields marked as mandatory in the entry form. These fields are: name, surname, personal identification code (not compulsory), date of birth, full postal address (city, street, number), telephone, e-mail. Once completed, the application form is registered in the KitchenShop database. The main customer identification element in the database will be the e-mail address provided when registering for this loyalty programme.

Completion of the registration form implies consent to the processing of the Participant's personal data, including for marketing purposes. The processing of personal data will be carried out only in accordance with the provisions of the legislation in force. Participants have the right to revoke their consent to the processing of personal data at any time, and may also request their deletion, understanding and accepting that by deleting their data, they lose their membership in this Programme.

Incomplete forms or forms containing erroneous data will not be validated, which will make it impossible to receive a valid virtual card. Correct completion of the form activates the card status with data in the system, with access to the use of accumulated points and direct discount.

Once the form has been completed and validated, customers will receive their KitchenShop e-loyalty (Member) card on the spot, as mentioned above. The e-card will be activated on the spot and can be used to pay for purchases or to accumulate points.

Obtaining the loyalty (Member) card is conditional on the purchase of one or more products in the KitchenShop store. KitchenShop reserves the right to change the way the card is offered at any time.

ARTICLE 6. BENEFITS OF THE LOYALTY CARD

The KitchenShop loyalty card offers the holder the following benefits:

  1. 3% discount on the value of the last purchase and conversion into loyalty points; 5 points = 0.01 euro (1 euro cent); 500 points = 1 euro; 1000 points = 2 euros. The owner can choose the type of action desired for each purchase:
    • - either accumulation of points,
    • - or payment for purchases, using all the points accumulated;
  2. additional bonus points, depending on the value of the purchases;
  3. promotions dedicated exclusively to KitchenShop club members;
  4. purchase of the product of the month in question at a substantial discount from the list price;
  5. participation in raffles with numerous attractive prizes.

Access to the use of accumulated points and direct discount is only possible for Participants who have a card with all mandatory data correctly filled in the system, i.e. they have fully completed the registration form as specified in these Official Rules.

Accumulated points cannot be transferred to another user or exchanged for cash.

Points are awarded only to individuals and are valid for 11 months from the date of accumulation. Unused points earned more than 11 months ago will be automatically cancelled from any KitchenShop loyalty card.

Loyalty card holders who make online purchases with accumulated points will still receive free shipping on their order if the order value is equal to or greater than the limit set in the KitchenShop offer.

ARTICLE 7. USE OF THE LOYALTY CARD

Use of the KitchenShop (Member) loyalty card may only be made by the holder. Otherwise, the cardholder assumes full responsibility for any problem that may arise in connection with the benefits of the loyalty card.

In order to accumulate points or to benefit from discounts, the Participant must be logged in to his/her membership account. The account will be charged with the points related to the current purchase. Access to discounts or promotions is possible in KitchenShop, except in special cases where promotions are only available in certain locations.

KitchenShop may deactivate or permanently suspend a loyalty card in case of fraud, attempted fraud or misuse of the loyalty program.

ARTICLE 8. RETURN OF PURCHASED PRODUCTS

If you wish to return products that you have paid for in full or in part with loyalty points, you will automatically receive back the points spent on those products and, if applicable, the difference in cash.

ARTICLE 9. DURATION OF THE LOYALTY PROGRAMME

The Loyalty Programme is of indefinite duration. KitchenShop may decide at any time to terminate the loyalty programme. Notice of the termination of the programme will be given at least 15 calendar days before the date of termination of the programme online and to any partners in the programme.

ARTICLE 10. VALIDITY OF THE LOYALTY CARD

KitchenShop reserves the right to cancel loyalty cards that have not been used for 11 consecutive months.

ARTICLE 11. PROTECTION OF PERSONAL DATA

By signing the registration form Participants agree to the provisions of these Official Rules. By signing the registration form, the participant expresses his/her express consent to the inclusion of personal data in the database of KitchenShop SRL, as well as to the processing of such data for the purpose of granting benefits according to KitchenShop's policy, for statistical purposes, for direct marketing actions, including receiving information materials from KitchenShop.

The Organiser is obliged to comply with the provisions of EU Regulation 679/2016 on the protection of personal data during the Programme and afterwards. Thus, the Organiser undertakes to keep the personal data of the Programme participants confidential and to use them in accordance with these Official Rules and the legislation in force. KitchenShop may transmit such data to third parties under strict confidentiality conditions, for the purposes set out in these Regulations.

The Organiser processes the personal data of the Programme Participants in accordance with the legal provisions for the protection of individuals with regard to the processing of personal data and the free movement of such data. The provision of the requested data is mandatory for participation in the Programme. Participants have, according to the laws in force, the following rights:

  • the right to information
  • the right of access to data
  • the right to rectify, to intervene on the data
  • the right to delete
  • the right to restriction
  • the right of portability
  • the right to object to data processing
  • the right not to be subject to an individual decision
  • the right to take legal recourse.

The Organiser undertakes to process personal data in accordance with the requirements and wishes of the Participant, respecting any of the legal rights mentioned above.

At the written request of the Participant, sent dated and signed, either by post to the address of the company's headquarters (Bucharest, sect. 2, Bd. Lacul Tei nr. 1-3, ISPE building, 5th floor) or by e-mail to dpo@kitchenshop.eu, the Organiser shall at least: (a) confirm to the applicant, free of charge, whether or not it is processing the applicant's personal data; (b) rectify, update, delete, etc. data whose processing does not comply with the provisions of the law, and/or (c) cease processing the applicant's personal data.

The participant may at any time modify his/her previously expressed options by submitting his/her new options in a written request, either by mail to the company's head office (Bucharest, sect. 2, Bd. Lacul Tei nr. 1-3, ISPE building, 5th floor), or by e-mail to dpo@kitchenshop.eu, or directly to his/her user account.

ARTICLE 12. AMENDMENT OF THIS REGULATION

KitchenShop reserves the right to amend these Rules at any time and undertakes to make these amendments public before operation, via the website www.kitchenshop.eu and any other communication channels it deems appropriate.

Any disputes arising between the Organiser and the Participants in this Loyalty Programme shall be settled amicably, and if this is not possible, the disputes shall be settled by the competent courts of law at the headquarters of the Organiser / KITCHENSHOP SRL.
